Membership Terms



  1. This agreement commences once you have completed the online joining process.
  2. Your membership starts immediately.
  3. You will be entitled to all the rights and privileges exercisable for the type of membership chosen.
  4. Membership only applies to the gym you joined.
  5. You must be 16 years or over to join a Ben Dunne Gym.
  6. Members are expected to act respectably at all times while using our facilities. Aggressive or unruly behaviour towards staff or other gym members will not be tolerated and will result in termination of your membership. The management of Ben Dunne Gyms have the right to refuse membership to any individual without cause. The management of Ben Dunne Gyms have the right to refuse membership to any individual without cause.
  7. Transfer of a membership is available upon request and an appropriate fee will apply.
  8. Direct Debit memberships are not transferable person to person or from gym to gym.



  1. UPFRONT MEMBERSHIPS: Ben Dunne Gyms only accepts upfront payments online by credit/debit cards. No Cash payments are accepted.
  2. All upfront membership fees are collected by us on the date of application.
  3. Membership runs from the date of joining until the last day of the final month in the term of your membership as displayed in the joining process.
  4. Approximately one month prior to the end of your current membership, you will be sent an email detailing your membership expiry date and the cost of renewing your membership.
  5. If a membership is not renewed before its specific renewal date, then it is deemed to have lapsed and you will not be allowed access to the gym’s facilities without payment.
  6. Membership may be renewed on payment of the prevailing fee and in accordance with the terms and conditions then in force.
  7. To receive the prevailing renewal rate, a member must renew their membership fee before the last day of their membership.
  8. All members joining on multiple person memberships will be treated as a single membership upon renewal.
  9. All memberships start and end under the agreed terms and conditions set out at the time of joining. No time will be transferred from older memberships to new membership.
  10. To avail of the lowest rate advertised, membership may be based on two or more people joining. Membership rates may vary between sites. Memberships purchased as part of a deal for 2 or more persons cannot transfer to other sites unless all parties in the original membership transfer and an appropriate fee will apply
  11. Membership promotions may vary from gym to gym.
  12. DIRECT DEBITS: A Joining Fee applies to all monthly direct debit membership sign ups. All new Direct Debit memberships are processed by a third party The Harland’s Services Ltd on behalf of Ben Dunne Gyms. ALL CORRESPONDANCE RELATING TO YOUR DIRECT DEBIT MEMBERSHIP PAYMENTS SHOULD BE ADDRESSED
  13. The Joining Fee and the first month’s membership fee is collected by credit/debit card on your membership application date upon joining online. Your second monthly membership fee will be collected one month after you have joined and will be collected on the same date (or the closest working day each month of your membership). These dates will be displayed in Step 2 of the membership application. Please take note of the dates shown for your records.
  14. Direct Debit payments will continue on a monthly basis until you notify of your wish to cease your membership. Cancellation requests must be sent at least two weeks prior to the Direct Debit collection date and you must also inform your bank.
  15. Non-payment of a direct debit payment will result in your membership being automatically cancelled. The prevailing advertised monthly fee and the joining fee will apply if you wish to re-join.
  16. You agree to advise us immediately of any changes to Member’s Details provided.
  17. Monthly Membership rates may vary between sites.
  18. From time to time we may need to increase the price of the monthly membership fee. We will give you at least 1 full months' notice of any incoming price increase and will make it very clear when the price increase will take effect and how much your membership fee will cost after the increase. During this period you will have your usual right to terminate your membership, in accordance with the membership terms and conditions and rules. If you do not terminate the membership by the date given to you in the notice then the price of your membership will be increased in accordance with our notice.
  19. Over 65's: Annual Upfront membership for over 65's applies to Westpoint, Carlisle and Northwood gym only. ID is required upon collection of the membership card. Any applicant outside the age requirement will be refunded immediately. To receive the over 65's rate advertised all applicants must sign up as new members.
  20. Full Membership where applicable covers use of all gym equipment, classes, changing facilities, showers and pool areas including, jacuzzi and steam rooms.

    Members found in breach of the rules of their membership type will be cancelled automatically



  1. As a member you agree to comply with the rules of the gym, which are prominently displayed, with regards to use of the facilities, opening hours, fire evacuation plan and your conduct. From time to time, the Gym may make reasonable changes to these rules provided the Gym gives advance notice of these changes. If you are not satisfied with these changes and wish to withdraw membership, a proportionate refund of the annual subscription will be made if requested.
  2. We may terminate this agreement with immediate effect on notifying you if you are in breach of the Gym Rules.
  3. On acceptance of an application for membership, the member will be issued with a membership card, which must be produced on each visit to the gym to gain admission. The card will remain the property of the gym and, upon termination of membership, will be returned to the gym.
  4. A valid photo ID must be produced before a membership card will be printed. i.e. passport/driving license.
  5. For security and validation reasons, management reserves the right to scan each member’s card at the reception in the gym. This will entail a member’s photo being made visible or projected on the screens adjacent to the reception desk for no more than 5 seconds.
  6. An appropriate fee is charged for the replacement of lost membership cards.
  7. All members must sign a Health Commitment Statement before they use the gym facilities.
  8. If you require assistance in using any equipment, please ask a member of our Fitness Team.
  9. Management reserves the right to alter, amend or change the Terms & Conditions and Gym Rules from time to time. The version on our website being the most up to date available.
  10. Members wishing to report problems with services at the gym should contact the Duty Manager (enquire at reception).
  11. The Gym may withdraw use of all or part of the gym for the purpose of undertaking maintenance work or any other work considered necessary for a maximum period of seven working days. Beyond that period, in the event of a member wishing to withdraw membership, a proportionate refund of the annual subscription can be made upon request.
  12. We may assign the benefits of this agreement to a third party on notice to you. Your rights under this agreement will not be prejudiced.
  13. This agreement is governed by Irish Law.

Personal Training

All Personal Trainers are independent and operate on a self-employed basis within the gym.

You can view all their personal details, individual pricing and qualifications on their personal advertisement biography board displayed within the gym.

PERSONAL TRAINERS ARE SELF EMPLOYED. Only Ben Dunne Gym APPOINTED Personal Trainers can operate within our gyms and train their clients (who must be Ben Dunne Gym’s members)

If you avail of the services of the Personal Trainers, the agreement in place is between you and the Personal Trainer. All sessions are booked and paid for directly to the Personal Trainer. Ben Dunne Gyms is not responsible and does not receive any fee for sessions or transactions between you and the Personal Trainer.

Please be aware of your rights and entitlements as a consumer when purchasing the sessions with your Personal Trainer.

Your personal Trainer must:
  • Provide you with a receipt for all payments.
  • Be registered as self-employed and be fully tax compliant.

You have the right to receive a refund from the Personal Trainer if the Personal Trainer does not/cannot provide you with the number of agreed and paid for sessions that you have signed up to.

Ben Dunne Gyms - Gym Rules

  • Members are deemed to have read and understood the Terms and Conditions of membership.
  • No person under the age of 16 is allowed into a Ben Dunne Gym. A valid Photo is required. i.e. passport or Driver’s Licence.
  • Members must use their membership card on each visit to gain access to Ben Dunne Gym.
  • The Membership access process and Member usage is monitored at all times to ensure the safety and security of our Members.
  • Any unauthorised access will result in membership cancellation.
  • Membership cards are for the sole use of the member to whom it was issued. It may not be passed on to anyone else. Any misuse of your membership card will result in the immediate termination of your membership.
  • Personal training is only permitted with Ben Dunne Gyms personal trainers.
  • For safety reasons, it is essential that the correct attire is worn when exercising i.e. suitable, comfortable exercise clothing and footwear.
  • Appropriate footwear is to be worn at all times on the gym floor. Only appropriate gym footwear is allowed. No stud or blade boots are allowed. Sandals are not deemed appropriate footwear.
  • As a courtesy to other members and for hygiene reasons we strongly suggest a small gym towel should be carried to wipe down equipment after use. Towels are available to purchase at reception.
  • All dumbbells and plate discs must be returned to the racks after use.
  • All classes operate on a first come first served basis. Please arrive in good time for a class to avoid disappointment.
  • Class attendance numbers are monitored and classes with low numbers may be removed from the timetable.
  • Members / Guests are solely responsible for their own belongings whilst visiting Ben Dunne Gyms. Ben Dunne Gyms Management accepts no responsibility for any loss or damage to personal property.
  • Members / Guests are only to use the lockers for the duration of their training session. Locks are available to purchase from reception for an appropriate fee.
  • Last showers are 30 minutes before closing time. Members / Guests must vacate the building no later than the official gym closing time.
  • Only equipment provided by Ben Dunne Gyms is allowed to be used on the gym floor.
  • Members must inform Ben Dunne Gyms of any change of contact and email address or telephone numbers.
  • Any incident or accident should be reported immediately to the Duty Manager in charge.
  • The Management reserves the right to amend, change the gym rules at their sole discretion.
  • The Management of each gym reserves the right to terminate or suspend Membership at any time and at its sole discretion.
  • Ben Dunne Gyms reserves the right to vary the opening hours, without prior notice, as considered necessary for the proper operation of the gym.
  • In the event of a member wishing to withdraw membership if a change of opening hours does not suit, a proportionate refund of the annual subscription can be given if requested.


Pool and Wet Area Rules where applicable.

  • Pool and Spa facilities close at 9pm Monday - Friday and 5pm Saturday, Sundays and Bank Holidays.
  • Members/Guests who are not competent swimmers should only use the pool when a competent swimmer accompanies them.
  • Members/Guests must shower before using the pool facilities.
  • Members/Guests must wear suitable swimwear at all times.
  • Members/Guests are asked to pay particular attention to the signage that defines the wet and dry areas in the locker rooms.
  • Members/Guests must dry off before leaving the shower area.


Fire Evacuation Plan

In the event of discovering a fire, please follow the following procedures:

  • Leave the building by the nearest available exit.
  • DO NOT stop to collect personal belongings.
  • DO NOT return to the building until authorised to do so.
  • DO NOT use lifts.


Health Commitment Statement

Your health is your responsibility. The management and staff of this organisation are dedicated to helping you take every opportunity to enjoy the facilities that we offer. With this in mind, we have carefully considered what we can reasonably expect of each other.

Our commitment to you

  1. We will respect your personal decisions, and allow you to make your own decisions about what exercise you can carry out. However, we ask you not to exercise beyond what you consider to be your own abilities.

  2. We will make every reasonable effort to make sure that our equipment and facilities are in a safe condition for you to use and enjoy.

  3. We will take all reasonable steps to make sure that our staff are qualified to the fitness industry standards as set out by the Register of Exercise Professionals.

  4. If you tell us that you have a disability which puts you at a substantial disadvantage in accessing our equipment and facilities, we will consider what adjustments, if any, are reasonable for us to make.


Your commitment to us

  1. You should not exercise beyond your own abilities. If you know or are concerned that you have a medical condition which might interfere with you exercising safely, before you use our equipment and facilities you should get advice from a relevant medical professional and follow that advice.

  2. You should make yourself aware of any rules and instructions, including warning notices. Exercise carries its own risks. You should not carry out any activities which you have been told are not suitable for you.

  3. You should let us know immediately if you feel ill when using our equipment or facilities. Our staff members are not qualified doctors, but there will be a person available who has had first-aid training.

  4. If you have a disability, you must follow any reasonable instructions to allow you to exercise safely.
