Membership Terms & Conditions

 



PRINCIPLE TERMS

 

  1. This agreement commences once you have completed the online joining process.

  2. Your membership starts immediately.

  3. You will be entitled to all the rights and privileges exercisable for the type of membership chosen.

  4. You cannot transfer this agreement to anyone else.

  5. Membership only applies to the gym you joined.

 



MEMBERSHIP FEES

 

  1. The membership fee is collected by us on the date of application.

  2. You agree to advise us immediately of any changes to Member’s Details provided.

  3. Membership runs from the date of joining until the last day of the final month in the term of your membership as displayed in the joining process.
  4. One month prior to the end of your current membership, you will be sent an email detailing your membership expiry date and the cost of renewing your membership.

  5. If a membership is not renewed before its specific renewal date, then it is deemed to have lapsed and you will not be allowed access to the gym’s facilities without payment,

  6. Membership may be renewed on payment of the prevailing fee and in accordance with the terms and conditions then in force.

  7. To receive the prevailing renewal rate, a member must renew their membership fee before the last day of their membership.

  8. All members joining on multiple person memberships will be treated as a single membership upon renewal.

  9. Memberships are not transferable.

  10. To avail of the lowest rate advertised, membership may be based on 2 or more people joining.

 



GENERAL TERMS

 

  1. As a member you agree to comply with the rules of the gym, which are prominently displayed, with regards to use of the facilities, opening hours, fire evacuation plan and your conduct. The Gym may make reasonable changes to these rules, from time to time, provided the Gym gives advance notice of these changes. If you are not satisfied with these changes and wish to withdraw membership, a proportionate refund of the annual subscription will be made if requested.

  2. We may terminate this agreement with immediate effect on notifying you if you are in breach of the Gym Rules.

  3. On acceptance of an application for membership, the member will be issued with a membership card, which will remain the property of the gym and, upon termination of membership, will be returned to the gym.

  4. A valid photo ID must be produced before a membership card will be printed. i.e. passport/driving license.

  5. For security and validation reasons, management reserves the right to scan each member’s card at the reception in the gym. This will entail a member’s photo being made visible or projected on the screens adjacent to the reception desk for no more than 5 seconds.

  6. An appropriate fee is charged for the replacement of lost membership cards at reception.

  7. All members must sign a Health Commitment Statement before they use the gym facilities.

  8. Management reserves the right to alter, amend or change the Terms & Conditions from time to time. The version on our website being the most up to date available.

  9. Members wishing to report problems with services at the gym should contact the Duty Manager (simply ask at reception).

  10. The Gym may withdraw use of all or part of the gym for the purpose of undertaking maintenance work or any other work considered necessary for a maximum period of seven working days. Beyond that period, in the event of a member wishing to withdraw membership, a proportionate refund of the annual subscription can be made upon request.

  11. We may assign the benefits of this agreement to a third party on notice to you. Your rights under this agreement will not be prejudiced.

  12. This agreement is governed by Irish Law

 

 


GYM RULES

 

  • No person under the age of 16 is allowed into a Ben Dunne Gym. A valid Photo ID may be requested where appropriate.

  • Members must use their membership card on each visit to gain access to Ben Dunne Gym.

  • The Membership access process and Member usage is monitored at all times to ensure the safety and security of our Members.

  • Membership cards are for the sole use of the member to whom it was issued. It may not be passed on to anyone else. Any misuse of your membership card will result in the immediate termination of your membership.

  • Personal Training is only permitted with Ben Dunne Gyms personal trainers.

  • For safety reasons, it is essential that the correct attire is worn when exercising i.e. suitable, comfortable exercise clothing and footwear.

  • As a courtesy to other members and for hygiene reasons, a small gym towel must be carried to wipe down equipment after use. Towels are available to purchase at reception.

  • All dumbbells and plate discs must be returned to the racks after use.

  • Members / Guests are solely responsible for their own belongings whilst visiting Ben Dunne Gyms. Ben Dunne Gyms Management accepts no responsibility for any loss or damage to personal property.

  • Members / Guests are only to use the lockers for the duration of their training session. Locks are available to purchase from reception for an appropriate fee.

  • Last showers are 15 minutes before closing time. Members / Guests must vacate the building no later then the official closing time.

  • Only equipment provided by Ben Dunne Gyms is allowed to be used on the gym floor.

  • Members must inform Ben Dunne Gyms of any change of contact and email address or telephone numbers.

  • Any incident or accident should be reported immediately to the Duty Manager in charge.

  • The Management reserves the right to amend, change the gym rules at their sole discretion.

  • The Management of each gym reserves the right to terminate or suspend Membership at any time and at its sole discretion.

  • Members are deemed to have read and understood the Terms and Conditions of membership.

  • Ben Dunne Gyms reserves the right to vary the opening hours, without prior notice, as considered necessary
    for the proper operation of the gym. In the event of a member wishing to withdraw membership if a change of opening hours does not suit, a proportionate refund of the annual subscription can be given if requested.

 

Pool and Wet Area Rules where applicable.

 

  • Members/Guests who are not competent swimmers should only use the pool when a competent swimmer accompanies them.

  • Members/Guests must shower before using the pool facilities.

  • Members/Guests must wear suitable swimwear at all times.

  • Members/Guests are asked to pay particular attention to the signage that defines the wet and dry areas in the locker rooms.

  • Members/Guests must dry off before leaving the shower area.

 

 

Fire Evacuation Plan

 

In the event of discovering a fire, please follow the following procedures:

  • Leave the building by the nearest available exit.

  • DO NOT stop to collect personal belongings.

  • DO NOT return to the building until authorised to do so.

  • DO NOT use lifts.

 

 

 

Health Commitment Statement

 

Your health is your responsibility. The management and staff of this organisation are dedicated to helping you take every opportunity to enjoy the facilities that we offer. With this in mind, we have carefully considered what we can reasonably expect of each other.


Our commitment to you

  1. We will respect your personal decisions, and allow you to make your own decisions about what exercise you can carry out. However, we ask you not to exercise beyond what you consider to be your own abilities.

  2. We will make every reasonable effort to make sure that our equipment and facilities are in a safe condition for you to use and enjoy.

  3. We will take all reasonable steps to make sure that our staff are qualified to the fitness industry standards as set out by the Register of Exercise Professionals.

  4. If you tell us that you have a disability which puts you at a substantial disadvantage in accessing our equipment and facilities, we will consider what adjustments, if any, are reasonable for us to make.

 

Your commitment to us

  1. You should not exercise beyond your own abilities. If you know or are concerned that you have a medical condition which might interfere with you exercising safely, before you use our equipment and facilities you should get advice from a relevant medical professional and follow that advice.

  2. You should make yourself aware of any rules and instructions, including warning notices. Exercise carries its own risks. You should not carry out any activities which you have been told are not suitable for you.

  3. You should let us know immediately if you feel ill when using our equipment or facilities. Our staff members are not qualified doctors, but there will be a person available who has had first-aid training.

  4. If you have a disability, you must follow any reasonable instructions to allow you to exercise safely.
