Your Membership With Ben Dunne Gyms

PRINCIPLE TERMS

  1. This agreement commences once you have completed the online joining process.
  2. Your membership starts immediately.
  3. You will be entitled to all the rights and privileges exercisable for the type of membership chosen.
  4. Membership only applies to the gym you joined.
  5. You must be 16 years or over to join a Ben Dunne Gym.
  6. Memberships are not transferrable.

MEMBERSHIP INFORMATION

  1. Monthly Membership is paid monthly on a direct debit.
  2. A Joining Fee applies to all monthly direct debit membership sign ups. All new Direct Debit memberships are processed by a third party Ashbourne Membership Management Ltd on behalf of Ben Dunne Gyms.  ALL CORRESPONDANCE RELATING TO YOUR DIRECT DEBIT MEMBERSHIP PAYMENTS SHOULD BE ADDRESSED TO: membershipsie@ashbournemanagement.co.uk. The Joining Fee and the first month’s membership fee is collected by credit/debit card on your membership application date upon joining online. The second and all subsequent monthly payments are collected through a direct debit and suitable bank account details are required.
  3. Your second monthly membership fee will be collected one month after you have joined and will be collected on the same date (or the closest working day each month of your membership). These dates will be displayed in Step 2 of the membership application. Please take note of the dates shown for your records.
  4. TO CANCEL YOUR MEMBERSHIP: Direct Debit payments will continue on a monthly basis, until you notify of your wish to cease your membership. Cancellation requests must be sent by email to membershipsie@ashbournemanagement.co.uk at least two weeks prior to the Direct Debit collection date and you must also inform your bank.
  5. Only a member can cancel their direct debit membership. A cancellation cannot be made by a third party on behalf of a member.
  6. Non-payment of a direct debit payment will result in your membership being automatically cancelled. The prevailing advertised monthly fee and the joining fee will apply if you wish to re-join.
  7. You agree to advise us immediately of any changes to Member’s Details provided.
  8. Membership rates may vary between sites.
  9. We reserve the right to increase the price of the monthly membership fees. We will give you 1 full months' notice of any incoming price increase and will make it very clear when the price increase will take effect and how much your membership fee will cost after the increase. During this period, you will have your usual right to terminate your membership, in accordance with the membership terms and conditions and rules. If you do not terminate the membership by the date given to you in the notice, then the price of your membership will be increased in accordance with the notice.
  10. Annual Memberships where applicable, are paid upfront for the agreed term, by a credit or debit card.
  11. Annual membership is not refundable. Distance selling rules apply and a 14 day cooling off period is applicable, where the service is not used.
  12. Gym membership does not include online classes.
  13. Management reserves the right to alter, amend or change the Terms & Conditions and Gym Rules from time to time. The version on our website being the most up to date available.
  14. Members found in breach of the rules of their membership type will be cancelled automatically.
  15. Members are expected to act respectably at all times while using our facilities. Aggressive or unruly behavior towards staff or other gym members will not be tolerated and will result in termination of your membership. The management of Ben Dunne Gyms have the right to refuse membership to any individual without cause.
  16. Services and facilities provided are at the sole discretion of gym management. Services and facilities may be amended at the discretion of the gym management.

GENERAL TERMS

  1. As a member you agree to comply with the rules of the gym, which are prominently displayed, with regards to use of the facilities, health and safety notifications and signage, opening hours, fire evacuation plan and your conduct. From time to time, the Gym may make reasonable changes to these rules provided the Gym gives advance notice of these changes. If you are not satisfied with these changes you are free to cancel the membership as the terms of joining.
  2. We may terminate this agreement with immediate effect on notifying you if you are in breach of the Gym Rules.
  3. On acceptance of an application for membership, the member will be issued with a membership card, which must be produced on each visit to the gym to gain admission. The card will remain the property of the gym. A valid photo ID must be produced before a membership card will be printed. i.e. passport/driving license.
  4. For security and validation reasons, management reserves the right to scan each member’s card at the reception in the gym. This will entail a member’s photo being made visible or projected on the screens adjacent to the reception desk for no more than 5 seconds.
  5. No entry is permitted without a membership card.
  6. Membership card spot checks are carried out and any misuse of a membership card will result in the cancellation of the membership.
  7. An appropriate fee is charged for the replacement of lost membership cards.
  8. All members must agree to the Health Commitment Statement during the joining process before they can complete the membership application online.
  9. If you require assistance in using any equipment, please ask a member of our Fitness Team.
  10. Members wishing to report any incident or problems with services at the gym should contact the Duty Manager immediately (enquire at reception).
  11. The Gym may withdraw use of all or part of the gym for any purpose of undertaking maintenance work or any other work considered necessary for the efficient operation of the gym for a max period of 10 days.
  12. Ben Dunne Gyms does not offer pool facilities.
  13. Personal training is only permitted with Ben Dunne Gyms personal trainers. Any member found Personal Training will have their membership cancelled immediately.
  14. We may assign the benefits of this agreement to a third party on notice to you. Your rights under this agreement will not be prejudiced.
  15. Car parking is available in all locations for a max period of 2 hours.
  16. This agreement is governed by Irish Law.

BEN DUNNE GYM - GYM RULES

  1. Members are deemed to have read and understood the Terms and Conditions of membership.
  2. Members must use their membership card on each visit to gain access to Ben Dunne Gym.
  3. The Membership access process and Member usage is monitored at all times to ensure the safety and security of our members.
  4. Any unauthorized access will result in membership cancellation.
  5. Membership cards are for the sole use of the member to whom it was issued. It may not be passed on to anyone else. Any misuse of your membership card will result in the immediate termination of your membership.
  6. Lockers are available on the gym floor and in the changing rooms.
  7. Last showers are 30 minutes before closing.
  8. All members must sanitize their hands on entering and exiting the gym.
  9. Members must adhere to the health and safety signage as displayed throughout the gym.
  10. Lockers are available on the gym floor for personal belongings. Locks are available to purchase from reception. Lockers are for use for the duration of the workout only.
  11. Items may not be left in lockers overnight and all locks are snipped at the end of the evening.
  12. Members / Guests must vacate the building no later than the official closing time
  13. Personal training is only permitted with Ben Dunne Gyms personal trainers.
  14. For safety reasons, it is essential that the correct attire is worn when exercising i.e. suitable, comfortable exercise clothing and footwear.
  15. Appropriate footwear must be worn at all times on the gym floor. Only appropriate gym footwear is allowed. No stud or blade boots are allowed. Sandals are not deemed appropriate footwear.
  16. In the interest of health and safety members must carry and use a hand towel to wipe down equipment after use. Towels are available to purchase at reception.
  17. All dumbbells and plate discs must be returned to the racks after use.
  18. Members / Guests are solely responsible for their own belongings whilst visiting Ben Dunne Gyms. Ben Dunne Gyms Management accepts no responsibility for any loss or damage to personal property.
  19. Only equipment provided by Ben Dunne Gyms is allowed to be used on the gym floor.
  20. Members must inform Ben Dunne Gyms of any change of contact and email address or telephone numbers.
  21. Any incident or accident should be reported immediately to the Duty Manager in charge.
  22. The Management reserves the right to amend, change the gym rules at their sole discretion.
  23. The Management of each gym reserves the right to terminate or suspend Membership at any time and at its sole discretion.
  24. Ben Dunne Gyms reserves the right to vary the opening hours, without prior notice, as considered necessary for the proper operation of the gym.

Your health is your responsibility. The management and staff of this organisation are dedicated to helping you take every opportunity to enjoy the facilities that we offer. With this in mind, we have carefully considered what we can reasonably expect of each other.

OUR COMMITMENT TO YOU

  • We will respect your personal decisions and allow you to make your own decisions about what exercise you can carry out. However, we ask you not to exercise beyond what you consider to be your own abilities.
  • We will make every reasonable effort to make sure that our equipment and facilities are in a safe condition for you to use and enjoy.
  • We will take all reasonable steps to make sure that our staff are qualified to the fitness industry standards as set out by the Register of Exercise Professionals.
  • If you tell us that you have a disability which puts you at a substantial disadvantage in accessing our equipment and facilities, we will consider what adjustments, if any, are reasonable for us to make

YOUR COMMITMENT TO US

  • You should not exercise beyond your own abilities. If you know or are concerned that you have a medical condition which might interfere with you exercising safely, before you use our equipment and facilities you should get advice from a relevant medical professional and follow that advice.
  • You should make yourself aware of any rules and instructions, including warning notices. Exercise carries its own risks. You should not carry out any activities which you have been told are not suitable for you.
  • You should let us know immediately if you feel ill when using our equipment or facilities. Our staff members are not qualified doctors, but there will be a person available who has had first-aid training.
  • If you have a disability, you must follow any reasonable instructions to allow you to exercise safely. This statement is for guidance only. It is not a legally binding agreement between you and us and does not create any obligations which you or we must meet.
